Professor Kerr, ordinarily among the most reliable of bloggers, states that the D.C.Circuit “denied [Scooter] Libby’s appeal,” which it most certainly did not do. The panel denied Libby’s motion for release pending appeal –a very different matter indeed. I expect Professor Kerr will correct this oversight, made in the course of suggesting that perhaps –just perhaps– Professor Dershowitz was overreaching in condeming the panel’s motivations. I would not raise such a point except for the fact that Professor Kerr is very widely respected and many might be misled by his characterization of the ruling. I believe President Bush did not pardon Libby because of the very real possibility that a panel on the merits will overturn Libby’s conviction.
