The Data Breach Battles
On Saturday I posted on the explosion of litigation surrounding data breaches. Yesterday a hearing before the Senate Judiciary Committee brought into the open the battle between businesses and banks over responsibility in the wake of big breaches.
My proposal on the weekend –a federal data breach safe harbor law– should remain the goal of both the banks and the businesses, but it seems a few rounds of blame-shifting must preceded seriousness. Actual CEOs as opposed to lobbyists and trade associations ought to get their internal cyber-security audit done and the memo sent round on best practices asap, and then push their D.C. reps to try and get everyone on the same page.
